Abstract

Land is very important for human life. Given the importance of the function of land for human life, then to provide legal certainty for the holder of the right to land, the land needs to be registered. The official authorized to register the land is the PPAT which has a very important role in maintaining the land registration data, ie making evidence about the occurrence of legal acts concerning a particular plot of land which then becomes the basis for registering the change of juridical data caused by the legal act. PPAT also assists the head of the land office as the executor of land registration, by providing evidence that will be the basis for registration of changes in land registration data. In addition, PPAT has the main duty to carry out part of land registration activities by making deed as evidence of certain legal acts. This research is empirical research with primary data as main data collected through interview technique, and also supported secondary data collected through literature study / document.

Abstract

The State of Indonesia emphasizes the principle of social justice explicitly. Article 27 paragraph (2), Article 28H paragraph (3) and 34 paragraphs (1), (2), (3) and paragraph 4) of the 1945 Constitution of the Republic of Indonesia mandate government responsibility in the development of social welfare. The Central Government provides regional autonomy to improve the welfare of the people within the framework of the Unitary State of the Republic of Indonesia. Local Government shall be given the right and authority to arrange and manage their own community welfare based on Law Number 12 Year 2009 regarding Social Welfare. One Billion One District Program is one of the Jambi Provincial Government's programs for the social welfare development of rural communities. This program was implemented by delegating some tasks and authority of the Governor of Jambi to the regent as head of the district administration. This research was conducted in Siulak Mukai Subdistrict with interview technique to get research data. In Siulak Mukai sub-district the success of this program in 2014-2015 is inseparable from the role of the sub-district head through the activities of home surgery, the cost of education of poor students / students, the procurement of agricultural machinery and non-agricultural equipment for farmer groups, business capital assistance, labor training and Health Insurance Area. However, in the implementation of this Samisake program there are several obstacles experienced by the subdistrict head, such as incomplete document of program beneficiary and limited operational fund.

Abstract

This article is the result of research that discusses the role of BAMUS Nagari in Lubuak Gadang Sangir Subdistrict, South Solok Regency of West Sumatera Province with the role of BPD in Lubuk Nagodang Village, Siulak Subdistrict Kerinci Regency, Jambi Province. This study uses primary data as the main data obtained from interviews and secondary data as support obtained from literature studies. Based on the results of the research, BAMUS Nagari Lubuak Gadang plays an important role in the development of the village, because BAMUS Nagari Lubuak Gadang is very active in collecting the aspirations of the people, establishing the Nagari Regulations well and carrying out supervision on development and development results. Compared with the BPD Lubuk Nagodang is less active in collecting aspirations from the community, the role of BPD in establishing the Village Regulation Lubuk Nagodang also not yet running well and BPD Lubuk Nagodang only oversee the development process without monitoring the results of development.

Abstract

The practice of the implementation of the Regional Head Election is always accompanied by disputes and conflicts. Through UU No. 12 Tahun 2008 on Amendment to UU No. 32 Tahun 2004 on Regional Government, the dispute over the General Election of Regional Head has been transferred from the Supreme Court to the Constitutional Court. The locus dispute settlement dispute is regulated in Article 236 C of UU No. 12 Year 2008. The change of dispute resolution to the Constitutional Court brings new hope because the settlement by the Constitutional Court is relatively not cause a significant conflict, so that democracy goes well. This is proven one of them is the settlement of disputes result of General Election of Head of Kerinci Regency by Constitutional Court with Decision No 125/PHPU.D-XI/2013. With the result of the decision of the Constitutional Court it can be ascertained that about the certainty of the elected Regent and Vice Regent Kerinci candidate who will lead Kerinci 5 years ahead. This research is normative research, that is studying result of Constitutional Court Decision No. 125/ PHPU.D-XI / 2013 about Dispute of Result of General Election of Region Head of Kerinci Regency.

Abstract

This study examines the role of Village Consultative Body (BPD) in preparing and establishing Village Rules. Article 1 of Law Number 6 Year 2014 explains that the village is a community unit adjacent to the authority to regulate and manage government affairs, the interests of community based initiatives, appropriate origins, and/or customary rights recognized and respected within the government system of the Republic of Indonesia. The publication of Law Number 6 Year 2014 on the Village brings the ideals of village renewal. The Village Consultative Body is an institution that performs a governmental function whose members represent the representatives of village communities based on their regional representations and are democratically established. The Village Consultative Body as an element of village government organization established as a democracy village forum has one important function based on Article 55 of Law Number 6 Year 2014 on Village, which is first, proposing/initiating, discussing and agreeing on the draft of village regulations with the Village Head. Second, to dig, collect, collect, formulate and channel the aspirations of the village community; Third as a partner of the village government, ie consult and coordinate each other in terms of making village regulations. This study uses secondary data as the main data collected through literature study and primary data collected based on interview results.

Abstract

The pattern of guidance in the penal system based on UU No. 12 Tahun 1995 concerning Pemasyarakatan is done gradually until the efforts of integrating prisoners and prisoners to the community through conditional free program in the form of Conditional Liberal (PB), Free Before Leave (CMB) and Conditional Leave (CB). To see the implications of this matter, it can be seen directly about the effectiveness of the program free of conditional in Prisons in its implementation in Lapas Klas IIA Padang which has over 200% capacity over the existing capacity. This study uses primary data as the main data obtained from interviews, supporting data is secondary data obtained from the results of literature research/document studies. Based on the result of the research, it is found that the procedure of Conditional Free Program implementation at Lapas Klas IIA Padang based on the provision of Human Rights Permenkum No. 21 Tahun 2013 which was amended by Permenkum HAM No. 21 Tahun 2016. Referring to the rule of Lapas Klas IIA Padang runs a conditional free program with administrative governance system in Lapas Klas IIA Padang intended to streamline and optimize the implementation of the program free of conditional, so it can be seen the effectiveness of the implementation of the program in overcoming the advantages Capacity at Lapas Klas IIA Padang based on percentage comparison parameters between the number of increase in the implementation of the program free of conditional with the percentage increase in the number of homes in Lapas Klas IIA Padang. The implementation of a parole program at Lapas IIA Padang faces several obstacles including obstacles in the legal administration system, constraints from prisoners and prisoners and the obstacles posed by legal rules that provide tightening on the implementation of the free program as regulated in PP Nomor 99 Tahun 2012.

Abstract

The certification of a land right for micro business and small is a government program which is implemented by National Land Agency (Badan Pertanahan Nasional). The program has purpose to provide certainty and legal protection for a right holder of a land and it is expected to alleviate the problems of micro business and small that do not have land right certificate. It can be committed by enhancing the access to capital of banks, so that, both of them can be more developed in order to improve people’s welfare. The findings of this study are based on two problems above. First, the issuance process of land right certificate for micro business and small in the district Sijunjung consists of pre-certification, certification, and post-certification. (1) Pre-certification of a land, is the authority of Department of Cooperatives, Industry, and Trade in the district Sijunjung. (2) Certification of a land right, is the authority of the National Land agency in the district Sijunjung. (3) Post-certification of a land right, is the authority of Department of Cooperatives, Industry, and Trade . Second, the implications of the issuance of land right certificate for both micro and small in the district Siunjung are: (1) ensuring legal certainty and legal protection for rights holders over land ownership, (2) providing the information required in performing legal acts of land affairs to related departments, (3) Resolve the land disputes, such as dispute of state administrative, civil, and criminal, (4) Land right certificate for micro and small owned by people or society can be used as collateral in banks to access the capital.

Abstract

This study examines the Implementation of UU No. 11 Tahun 2012 on the Criminal Justice System of Children against traffic violations committed by the Child. This is motivated by the process of settling cases of traffic violations committed by the Child ranging from the level of investigator to trial in court is not based on UU No. 11 Tahun 2012, so that contrary to the principle of the Criminal Justice System of the Child such as not paying the best interest for the Child, The right of the Child to deal with the law. This study uses secondary data as the main data obtained from literature / document studies supported primary data in the form of interviews. Based on the result of the research, it is found that Implementation of UU No. 11 Tahun 2012 on traffic violations conducted by children has not been applied maximally, not yet apply the concept of restorative justice so that contrary to the principles of the Criminal Justice System Law of Children does not give priority to the best interests for the Children. Second, the obstacles faced in the implementation of UU No. 11 Tahun 2012 on the Criminal Justice System for Child Trafficking violations committed by the Child is caused by several factors, including: Disharmony UU No. 11 Tahun 2012 on Child Criminal Justice System with UU No. 22 Tahun 2009 on Road Traffic and Transportation, Lack of Implementing UU No. 11 Tahun 2012 on Child Criminal Justice System, Regulation of UU No. 22 Year 2009 on Traffic and Road Transport that is not appropriate with the current situation, Knowledge and Law enforcement mindset.

Abstract

Given the importance of the presence of a witness in the criminal justice process to discover material truths, the function and position of witnesses are privileged and desirable for the parties involved in the criminal justice process. Especially for the relieving witness, his presence is expected by the defendant to provide information in the proceedings aimed at relieving the defendant and can be used as a consideration for the prosecutor in filing a lawsuit in the criminal justice process, as well as to convince the judge in taking the decision. Witnesses filed by a suspect or a defendant who is expected to provide a favorable testimony to him is called a de charge witness.

Abstract

PBB-P2 is a tax whose delegated authority is transferred to the Regency / City Government. Kerinci Regency Government began applying the Land and Rural Land and Urban Tax collection from January 1, 2014. This research was conducted to find out how the implementation of tax collection of earth and rural and urban buildings in Detailed District and to find out how its contribution to the original revenue area in Kerinci regency. This research uses primary data in the form of interview result as main data, and secondary data as supporter. Based on the result of this research, it is found that the taxation of earth and rural and urban building in Kerinci Regency has not run optimally, because the officer has not consistently run the regulation, so that its contribution to the local revenue is not optimal only about 1.23% in 2014 and 1.19 % By 2015.
